General terms of sale

The present General Terms of Sale define the conditions applicable to sales concluded between, on the one hand, the individuals wishing to make a purchase via the website of Roaring 20s Paris https://roaring20s_paris.com, hereinafter referred to as "the Client", and on the other hand "Roaring 20s Paris", a company whose registered office is located at 14, quai de la Mégisserie – 75001 Paris, France, registered in the Paris Trade and Companies Register under number 833 627 714, email address: roaring20sparis@gmail.com (hereinafter "the company" or "we").

Roaring 20s Paris is a registered and protected trademark.
It was registered on June 25, 2021 in the Official Bulletin of the National Institute of Intellectual Property (INPI) under the national number 21 4 780 013.
The company engages in the trade of watchmaking articles and accessories, represented by its managing partner, Mr. François Morice, residing in Paris (75).

The Client and Roaring 20s Paris are hereinafter referred to as “the Parties”.

These conditions apply exclusively to non-commercial individuals.

Acquiring a good through this site implies full and unconditional acceptance of these General Terms and Conditions of Sale.

Article 1 – Order

1.1 The shipment of packages is carried out only in metropolitan France.
1.2 The Client's order concerns products listed in the online catalog of Roaring 20s Paris.
1.3 The order can only be recorded if the Client has clearly identified themselves (first name, last name, valid email address, postal address, phone number, and date of birth).
1.4 Any order constitutes acceptance of the prices and descriptions of the products available for sale.
1.5 Orders are payable only in euros including VAT.
1.6 Roaring 20s Paris commits to honoring orders received within the limits of available stock.
1.7 The sale dates applied are those in effect in the region where the company's headquarters is located.

Article 2 – Validation

2.1 By validating their order, the Client acknowledges having read and accepted without reservation these General Terms and Conditions of Sale.
2.2 Unless proven otherwise, the recorded data by Roaring 20s Paris constitutes proof of all transactions.

Article 3 – Availability

3.1 Offers and prices are valid as long as they are visible on the site and within the limits of available stock.
3.2 In case of unavailability of a product after order validation, Roaring 20s Paris will inform the Customer as soon as possible. The order will be canceled or modified at the Customer's request.
3.3 Availability information is provided for informational purposes only: products are only reserved after payment.

Article 4 – Delivery

4.1 The preparation time is 24 to 48 hours. Delivery takes place in 2 to 5 working days in metropolitan France and the USA, 2 to 7 days in the DOM-TOM, and up to 8 days internationally.
4.2 In case of items deliverable on different dates, the longest delay prevails. Roaring 20s Paris reserves the right to split the delivery at no extra cost to the Customer.
4.3 In case of a delay of more than 14 days, the Customer may request the termination of the contract and a refund within 14 days.
4.4 The Customer must check the contents of the package upon receipt and report any anomalies to roaring20sparis@gmail.com

Article 5 – Payment

5.1 Prices are indicated in euros including VAT (20%), excluding shipping costs.
5.2 Roaring 20s Paris reserves the right to change its prices at any time.
5.3 Products are billed according to the rates in effect at the time of the order.
5.4 Products remain the property of Roaring 20s Paris until full payment.
5.5 Payments are made by credit card or PayPal.
5.6 Transactions are secured via Stripe (SSL – Secure Socket Layer solution). All data is encrypted to ensure confidentiality.

Article 6 – Returns and Refunds

6.1 Order Error:
In case of an error attributable to Roaring 20s Paris, return and reshipping costs are the responsibility of the company.

6.2 Customer Withdrawal:
The Client has a legal period of 14 days from the receipt of the package to exercise their right of withdrawal.
Return shipping costs are the responsibility of the Client (except in exceptional cases).
Products must be unused, unworn, and in their original packaging.

6.3 Refund:
The refund is processed within a maximum period of 7 days after receipt of the compliant items.
The refund includes initial shipping costs, if charged.
Damaged, worn, or modified products are neither exchanged nor refunded.

Article 7 – Warranty

7.1 Roaring 20s Paris guarantees its products against hidden defects and manufacturing defects for 14 days after receipt.
7.2 This warranty does not cover: consumables (batteries, straps…), damages related to abnormal use, or unauthorized interventions.

Article 8 – Liability

8.1 Product photos are presented for illustrative purposes.
8.2 Roaring 20s Paris disclaims any responsibility regarding the content of external sites accessible via hyperlinks.
8.3 In case of purchase for professional purposes, no compensation will be due for indirect losses.
8.4 Roaring 20s Paris acts as a reseller on catalog and cannot be held responsible for defects related to manufacturers.
8.5 The company cannot be held responsible in case of force majeure or fault attributable to the Client.

Article 9 – Mediation

In accordance with articles L612-1 and following of the Consumer Code, any unresolved dispute may be submitted to a consumer mediator, free of charge for the Client.

Article 10 – Anti-fraud measures

10.1 Information related to the order is subject to automated processing for fraud detection (via WordPress/Stripe).
10.2 In case of non-payment due to fraudulent use, the Customer's details may be recorded in a payment incident file.
10.3 In accordance with the Data Protection Act n°78-17 of January 6, 1978, the Customer has a right of access, rectification, and opposition by writing to:

Article 11 – Applicable Law

This contract is subject to French law.
In case of dispute, only the French courts have jurisdiction.
This contract is written in French.

Article 12 – International Orders

12.1 The Customer is the importer when ordering from another country.
They are responsible for the payment of customs duties, local taxes, or import fees applicable.
12.2 The Customer must check the legislation of the destination country before placing any order and ensure that the products are allowed for import.

Article 13 – Gift Cards

Gift cards are neither exchangeable, nor refundable, nor convertible into cash.
No price difference will give rise to a refund by Roaring 20s Paris.
